Intermountain Cup Terms of Service
Effective Date: January 1, 2025
Welcome to the Intermountain Cup (“Company,” “we,” “our,” or “us”). By accessing or using our website [www.intermountaincup.com], registering for our events, or participating in our races, you agree to the following Terms of Service.
1. Eligibility You must be at least 18 years old to register. Participants under 18 must have a parent or guardian complete registration on their behalf.
2. Registration & Payment Registration is complete only after full payment is received. Registration is non-transferable except as explicitly allowed by our deferral/transfer policy (see Section 3). All payments are processed securely through third-party providers; we do not store payment card details.
3. Refunds, Deferrals & Transfers No Refunds: Entry fees are non-refundable for participant cancellations, including injury, illness, or DNF (Did Not Finish). Deferrals/Transfers: You may defer (change) your entry to another Intermountain Cup event in the same calendar year or transfer it to another rider up until 9:00 AM the Thursday before the race. After that time, no changes are permitted. Event Cancellations by Organizer: If an event is cancelled on race day due to weather or conditions, participants will receive a 50% discount coupon toward a future event. If an event is cancelled before the event date, participants will receive a 100% refund.
4. Assumption of Risk & Liability Waiver Mountain bike racing carries inherent risks, including injury or death. By registering, you voluntarily assume these risks. You agree to release and hold harmless Intermountain Cup, its officers, employees, contractors, volunteers, sponsors, and partners from any claims, damages, or liabilities arising from your participation, except in cases of gross negligence or willful misconduct. Pre-riding of courses is done entirely at your own risk. Helmets are mandatory. Use of headphones during racing is prohibited.
5. Code of Conduct Participants, volunteers, and spectators must: Treat others with respect and sportsmanship Follow race rules, staff instructions, and safety guidelines Avoid dangerous, disruptive, or unlawful behavior Failure to comply may result in disqualification, removal from the event, or suspension from future events without refund.
6. Intellectual Property & Media Use All website content, race materials, and logos are the property of Intermountain Cup. By participating, you grant us permission to use race photos, videos, and results (including your name and likeness) for promotional and marketing purposes, unless you notify us in writing.
7. Website Use You agree not to misuse our website or attempt unauthorized access. We may restrict or terminate access to the website for violations.
8. Governing Law & Dispute Resolution These Terms are governed by the laws of the State of Utah. Any disputes will be resolved through binding arbitration in Utah, unless otherwise prohibited by law.
9. Changes to These Terms We may update these Terms from time to time. The latest version will always be posted on our website. Continued use of our website or participation in our events means you accept the updated Terms.
